a san jose mother admits to a kidnapping hoax and may farmings and jail time, as well. cbs 5 reporter anne makovec down in san jose where neighbors and police are not too happy about this, i guess, anne, right? >> reporter: obviously not. the big question this morning, why would this mother do this? this community has gone from fear to shock to anger in the past few days. our reporter tracked down this woman yesterday but she refused to answer any questions. on tuesday, police say she told them someone tried to steal her toddler from her arm. in front of their house on dayo court and even helped police make a sketch of that man. it then put the whole neighborhood on alert. police became suspicious when canvassing the area for witnesses and surveillance video. then they got nothing from that search. so they started focusing on the mother after they learned she had a criminal history. they won't give any specks about that. they are not mincing words

about it lie. >> despicable. you can't say enough about anybody who presents information like this especially when dealing with kids and to think about the lies that she created. >> reporter: so now it is going to be up to the district attorney here in santa clara county to decide whether or not to charge this woman. penalties could be up to 6 months in jail if they do. right now live in san jose, anne makovec, cbs 5. >> thank you. former cyclist lance armstrong is now confirming the suspicions of many that he used performance-enhancing drugs. part of an interview with oprah winfrey aired last night. >> yes or no, did you ever take banned substances to enhance your cycling performance? >> yes. >> yes or no, was one of those banned substances epo? >> yes. >> did you ever blood dope or use blood transfusions to enhance your cycling performance? >> yes. >> armstrong said he did not

invent the doping and banned substance culture but he didn't stop it, either. >> my cocktails so to speak was only epo but not a lot, transfusions and testosterone, which in a weird way i almost justified because of -- because of my history obviously with testicular cancer. >> armstrong added that he did not feel he was cheating. he said he looked up the definition of cheating and it read, gaining an upper hand on a competitor. he said he didn't feel he was doing that. he was just leveling the playing field. armstrong says he will spend the rest of his life trying to earn back trust but knows some won' forgive him. a wife of a former teammate said she heard armstrong confess to doctors during his cancer treatment that he used performance-enhancing drugs. he says armstrong then questioned her sanity. >> he owed to to me.

abduction. >> can you explain what happened? >> reporter: that is the mother refusing to answer our reporter's questions last night. the woman originally claimed a man tried to grab her daughter a toddler from her arms in her front quart on dayo court in san jose and now investigators say the whole thing is a lie. >> there's a lot of anger again with the amount of resources not only for our detective who are out there trying to solve legitimate crimes. >> i was angry when i heard it was a lie because i thought, wow, she put us you there a lot of anxiety. >> reporter: police say the mother does have a criminal record which is why they started to focus on her during the ordeal when they didn't find any other real evidence of an abduction. lying to police is a misdemeanor and she could face six months in jail or a $1,000 fine. that is going to be up to the santa clara county district attorney to decide whether she

california? we'll find out later today from health officials. a 98-year-old santa clara county woman is the first person to die from the virus in the golden state. cbs 5 reporter elissa harrington joins us now with more on that and where you need to go for a flu shot. elissa. >> reporter: good morning, michelle. that's right. that 98-year-old woman was from santa clara county and she died earlier this month from the flu and pneumonia. this marks the first bay area death from the flu this season. four other people in the state have also died one of them in sacramento. another in the central valley and two in southern california. officials with the centers for disease control say this is the worst flu season in 10 years. it's now widespread throughout california. and it came early. it usually doesn't peak until february or march. health officials are urging people to wash their hands, cover their coughs and get a flu shot. >> they really should see their physicians. there are other things that they can do. there are antiviral drugs such as tamiflu that can be used to

help treat those people that have been exposed or who are at higher risk for complications of flu. >> reporter: getting the vaccine is the best way to avoid getting sick. it has a 62% level of effectiveness. some pharmacies are scrambling to stay stocked. safeway just got 200,000 more doses. these are safeways throughout the whole country. so you can come in here during regular business hours no appointment no prescription. and the safeway on king street in san francisco opens at 9 a.m. live in san francisco, elissa harrington, cbs 5. of the san francisco giants' pablo sandoval is in a venezuelan hospital being treated for abdominal pain. a twitter posting by his brother michael says the third baseman was diagnosed with colitis but is expected to be okay. sandoval has been playing winter ball in the venezuelan league. a janitor suspected in a deadly case of vigilante justice is due in a san jose

courtroom today. luis ricardo hernandez is accused of shooting and killing a suspected burglar at the apartment building where he works. it happened new year's eve on lewis road. his attorney says hernandez took action because he believed the victim was behind a series of auto burglaries there and was frustrated with the lack of police response. well, imagine if you stumbled upon a burglary happening in broad daylight, what would you do? ford frazier of the redwood heights section of oakland says he was nearly shot by those burglars when he tried to call for help. tuesday afternoon he saw three men across the street in his neighborhood trying to break in a neighbor's home. he called thine 101 and waited on hold as the men tried but failed to get inside that home. >> i'm standing here on the phone, and they're coming across the street there getting in the car. and the guy to be a shot at me look this and the bullet just is right in the wall over there, you see that black mark. >> the burglars got away. frazier says he was on hold for

heading into walnut creek where he says the drive is off to a great start. smooth through the san ramon valley. westbound 580 a little sluggish right now up to 22 minutes from the altamont pass out towards the dublin interchange through livermore. that's where we are starting to see a few brake lights. coming up we'll get a last check of the bay bridge toll plaza. in the meantime, back to you guys. intel reports a sharp drop in its 4th quarter earnings and as expected investors are not liking it. >> they are not liking it at all. let's chat about it. kcbs radio's financial reporter jason brooks joins us now on a friday. >> reporter: good morning. intel has all sorts of concerns out there for investors. they did top expectations even though revenue was down 3% to $13.5 billion. profits fell 27% to less than $2.5 billion. the key for intel is getting its chips into smartphones and tablets an area in which it's struggled. it saw a serious weakness in its pc sales last year.

server side did well. but a lot of investors are concerned that intel will struggle to quickly turn and and get those chips into tablets and smartphones. as a result, its stock is falling off this morning. it's down now by 6.5%. that's a big weight on the blue chips this morning. also saw a big drop-off in 2012 in venture capital funding. according to pricewaterhousecoopers, funding was down to $26.5 million. a number of deals down by 6%. facebook's ipo didn't go well and a number of other companies also struggled so that fell back. also vp funding really falling back in biotech and clean tech firms. they will struggle this year. stocks off to a modest start after a strong day yesterday. dow is up by 2 points. nasdaq though is down by 6. s&p is moving lower by 1 point back

reasons why you don't see it as much michelle is that san francisco and the bay area actually -- remember, we have two football teams here. we have the 49ers and the raiders and if you want to see fans that are dedicated and always wearing the colors, you go to the east bay and the raiders. i mean, they are their cars, tatoos, their husbands, they have their wives, they are all silver and black. >> yeah. and as the police chief i would just as soon see the raiders go to the east bay. stay over there. we like the team but not the fans. >> i think the weather has something to do with it. >> are you ready for the post- game sunday? >> but again, we're a class town so we want everybody to be really classy when the 9ers win on sunday and give them a big town to come back to that's not all banged up. >> you guys are white wine and brie cheese. >> we don't do that stuff. if you want to see us express ourselves, you show up at any bar right after the game. and you will see who we really are. >> if i show up at the bar after the game, and i do, i think i'm going to take him

welcome back. a check of your top stories now on a friday. about 64 hostages are unaccounted for as the drama drags on in algeria. the captors may want to trade two americans for terror figures jailed in the united states. estimates vary regard, the number of hostages and captors killed during an algerian military raid intended to free all the hostages. the captors are militants related to al qaeda upset about france's military action against islamic militants in neighboring mali. a san jose mother is admitting that she lied to police about an attempted kidnapping. she claimed that the man tried to take her 3-year-old daughter from her arms on her front lawn but investigators say the mother admitted to making it all up after just 10 minutes of questioning. police say the mother does have a criminal record and now she could face some new charges. and a 98-year-old santa clara county woman has died
